Autonomiczny charakter klauzuli arbitrażowej w międzynarodowym arbitrażu handlowym

Abstrakt

Artykuł analizuje zasadę autonomii klauzuli arbitrażowej w międzynarodowym arbitrażu handlowym. Zasada ta, uznawana za fundament arbitrażu, wskazuje na niezależność klauzuli arbitrażowej od umowy głównej, w której się znajduje. W praktyce oznacza to, że nieważność lub wygaśnięcie umowy głównej nie wpływa na ważność klauzuli arbitrażowej. Sąd arbitrażowy, powołany do rozstrzygania sporów na podstawie klauzuli, może orzekać o ważności samej umowy głównej, co istotnie poszerza jego jurysdykcję. Artykuł omawia ewolucję zasady autonomii, jej zakres i uzasadnienie, odwołując się do regulacji międzynarodowych, orzecznictwa i praw krajowych.
