As a result of the intensification of international trade and individual mobility, the cross-border issues are gaining importance. Transnational legal relations pose many difficulties for those who apply the law, ranging from the need to determine the jurisdiction of courts and the law applicable in the case at hand to recognition and enforcement of foreign judgments, of both state courts and arbitration tribunals, as well as decisions of other public authorities. The mission of Problemy Prawa Prywatnego Międzynarodowego (“Problems of private international law”) is to publish in-depth scientific studies concerning the above mentioned topics.
One of the main objectives of private international law in its broadest sense is to seek to resolve cross-border disputes between private law actors in such a manner that the "international harmony of decision making" is achieved. This objective encompasses the respect for different legal systems and cultures as well as deference for the competence of foreign courts to adjudicate in cases related to foreign territories. It also includes the need to honor the legal situations established abroad and the legitimate expectations of the parties to have their rights and obligations acquired therein respected. Essentially, the goal of private international law also to search for solutions that will ensure, as far as possible, conflict-free co-existence of societies and nations, while at the same time ensuring protection of the fundamental principles and values of one's own legal order. By stimulating scholarly discussion in the aforementioned area, the Journal seeks to influence the case law of the courts and other public authorities, as well as legal practice in general.
Problemy Prawa Prywatnego Międzynarodowego is the only periodical in Poland devoted entirely to the issues of cross-border private law transactions. The Journal publishes research papers in the field of private international law (conflict-of-laws), comparative law, international civil procedure, international commercial law and international arbitration. It has a highly specialized character. Problemy Prawa Prywatnego Międzynarodowego is addressed to experts interested in cross-border private law transactions: not only academics but also practitioners seeking in-depth studies in the field. The Journal is a continuation of Problemy Prawne Handlu Zagranicznego (“Legal Problems of International Trade”), which was published from 1977 through 2000. Even before the socio-political transformation, the Journal was a pioneer that dealt with legal issues of international trade, taking into account knowledge, experience and legal practice from market economies. The editors wish to maintain this groundbreaking, focused, and international in content character of the Journal in a new, extended formula, also covering issues beyond commercial relationships.
The editors of the Journal accept for publication papers concerning the problems of cross-border private law transactions in the broad sense of the term, i.e. from the fields of:
- private international law (conflict-of-laws),
- uniform law
- international civil procedure,
- international commercial and investment arbitration,
- other forms of alternative dispute resolution,
- comparative law in the area of private law,
- European Union law and public international law in so far as they concern private law transactions.
Problemy Prawa Prywatnego Międzynarodowego publishes papers primarily in Polish and English. Exceptionally, the Journal accepts also work in other languages (French, German or other “congress languages”).
All studies published in the Journal are available in open access (as defined by the Directory of Open Access Journals) at https://journals.us.edu.pl/index.php/PPPM. The papers are published in an "online first" format (as soon as they accepted and ready for publication) and then as part of the complete volumes, twice a year. Articles are available in pdf format both as individual papers and as a part of the entire volume. As a rule, the journal is published only electronically online.
Articles published in Problemy Prawa Prywatnego Międzynarodowego are available or indexed also in the following databases: ERIH PLUS, Copernicus, BazHum, CEEOL and in the Polish legal information system Lex Omega.
The access to all volumes of the Journal is preserved via the Open Journal System, used in the publication process, as well as on separate hard drives. The archived content will be accessible without any time limits, even if the Journal is discontinued. Furthermore, the University of Silesia Press passess a copy of each volume to the National Library, as required by the applicable rules of law.
The editors of the Journal apply anti-plagiarism and anti-duplication procedures, standards for avoiding conflicts of interest and other ethical policies. The publication ethics rules applied are in accordance with the guidelines of the Committee on Publication Ethics (COPE).
Problemy Prawa Prywatnego Międzynarodowego is owned and published by Wydawnictwo Uniwersytetu Śląskiego in Katowice (University of Silesia Press), Poland and is managed by the editors named below. The Editorial Board is assisted by the teams of editors at the publishing house. All papers are published under the "Creative Commons Attribution-Identity 4.0 International" licence (to be found here), which the authors grant to Wydawnictwo Uniwersytetu Śląskiego upon publication. Given that the licence granted to the University of Silesia Press is not exclusive, the authors retain the copyright and full publishing rights without restrictions.
The journal does not preclude the authors from depositing their work (whether a submitted, accepted or published version of the work) in an institutional or other repository of their choice.
The Journal applies the Principles of Transparency and Best Practice in Scholarly Publishing.
No charges are due for publishing papers, nor for the review or editorial procedures. The costs of editing, reviews, and publishing the papers in the Journal are financed by the University of Silesia from its own sources. In the years 2019-2020, the Journal was supported by a grant from the Ministry of Education and Science as part of the „Wsparcie dla Czasopism Naukowych” programme.
