Indoles obligationis omnium christifidelium vires suas ad sanctam vitam ducendam conferrendi elucidatur. Certo certius indoles istius obligationis religiosa et pro christifidelibus ethica est. Nunc autem de vita sancta pro posse ducenda in can. 210 CIC sermo est. Norma ex propria sua natura religiosa et ethica inter praescripta iuris invenitur. Quaestio ergo oritur num hoc in casu (et in similibus) norma talis etiam iuridica perspici debeat. Opinio probatur de iuridica, scilicet canonica, indole obligationis de qua in can. 210. Obligationi in lege statutae indoles iuridica negari nequit, etiamsi illa primo et principaliter ad ordinem religiosum et/vel ethicum pertineat. Receptione in codicem iuris genuina indoles religiosa et ethica non aufertur nec absconditur. Etiam in societate civili normae pariter morales, sociales et iuridicae funguntur. Dicisio de iuridica comprehensione normarum cuiuslibet generis ad legislatorem pertinet. Differentia in reciproca habitudine ordinis moralis et ordinis iuridici haeret. Legislator civilis multo magis consensum fundamentalem societatis perspicere debet, legislator ecclesialis ad fidem et mores ab Ecclesia praedicatas se refert. Ad eum, qui in eadem persona pastor et fidei magister est, pertinet quasnam obligationes in forma etiam iuridica proponenda censeat. Hoc modo profert in casu de faciendis vel omittendis gravis ponderis agi. Normae tales non directe iudiciabiles sunt, sed elementa magni momenti in systemate iuris canonici praebent, ideoque normis vere iuridicis annumerandae sunt. Inseruntur in legem non ob rationes aestheticas, v.g. ad indolem codicis theologicam prae oculis trahendam, non sunt leges symbolicae ad ideas proclamandas, eorum praesentia in codice ut in toto necessaria aestimanda est. Ecclesia, quae indefectibiliter sancta creditur, iure gaudet postulandi, ut fideles ad vitam sanctam ducendam vires suas adhibeant. Postulatum hoc et exspectatio norma can. 210 exprimitur. Qui normam hanc non observat, non reddit Ecclesiae quod istius est.
