Simulatio partialis de qua in C. 1086 §2 et doctrina de matrimonio constitutionis Gaudium et Spes

Abstract

Non est qui ignoret magnam vel immo maiorem partem nupturientium matrimonium contrahere cum animo prolem nascituram vel quoad tempus nascendi vel quoad numerum filiorum statuere. Limitatio prolis est plurimis coniugibus res magni momenti ob conditiones physicas, oeconomicas, psychologicas vel sociales. Inde oriuntur non solum problemata ordinis moralis, nostrum propositum directe non spectantes, sed etiam quaestiones directe c. 1086 § 2 tangentes. Ad mentem enim c. 1086 § 2 qui positivo actu voluntatis excludat essentiales proprietates matrimonii vel omne ius ad actum coniugalem, invalide contrahit. Hoc in casu habetur simulatio sic dicta partialis.
Ex dispositionibus c. 1086 § 2 de simulatione partiali gignitur quaestio de validitate matrimonii nupturientium, qui tempus vel numerum prolis nasciturae statuunt. Ad quaestionem hanc solvendam distinguitur inter voluntatem non se obligandi et voluntatem non implendi, inter exclusionem iuris et usum iuris. Matrimonium in primo tantum casu est invalidum. Sed nupturientes plerumque distinctionem hanc non cognoscunt. Numquam dicunt: ius ad prolem excludo, sed dicunt tantum: prolem nunc generare non possumus. An hoc in casu agatur de iure excluso vel usu, non est facile determinare et res est ex toto complexu causae discernenda. Attamen distinctio inter exclusionem iuris et limitationem usus iuris sustentatur, quia secus dispositiones de simulatione partiali fatales essent pro sacro vinculo matrimoniali. Theoretice enim ex c. 1086 § 2 patet exclusionem etiam temporaneam generationis prolis secumtrahere nullitatem matrimonii.
Eiusdem naturae difficultates vidimus quoad exclusionem aliorum bo- norum matrimonii. Non enim solum is qui absolute sibi reservat ius faciendi divortium civile, sed etiam is qui divortium hypothetice, si casus ferat, intendit, invalide contrahit. Permulti catholici matrimonium contrahunt illum felix fore sperantes sed simul scientes illos matrimonio eorum infausto ab divortio et pro occasione novo matrimonio scilicet civili tantum non abhorrituros.
In articulo examinatur doctrina de matrimonio constitutionis Gaudium et spes et conclusiones dispositiones iuris et doctrinam de consensu matrimoniali spectantes. In effectu proponitur revisio c. 1086 § 2 hoc in sensu, ut nullitas matrimonii tantum a simulatione totali causetur.
Bona vinculi et bonum alterius partis titulo nullitatis ex dolosa deceptione tutanda sunt.
