An important issue that requires in-depth consideration in the context of the issue of enforcement of judgments on the obligation imposed on the perpetrator to compensate for the damage inflicted or to make reparation for the harm suffered by the aggrieved party is the issue of the possibility to modify them (change the manner, scope or even revoke them) in enforcement proceedings. This raises the question: Is the executing authority entitled to make any changes (and if so, what changes) to the part of the judgment that concerns the obligation to compensate for the damage or harm suffered? Whether or not on the grounds of criminal law it is permissible to apply the institutions regulated in Article 453 of the CC, that is, datio in solutum (the essence of which consists in the fact that an obligation expires if the debtor, with the creditor’s consent, performs another service in order to be released from it), as well as in Article 509 of the Civil Code, the so-called assignment of claims (under which the creditor may, without the debtor’s consent, transfer a claim to a third party, unless this would be contrary to the law, a contractual stipulation or the nature of the obligation) and in Article 365 of the CC, that is, alternate obligations, or even in Article 506 of the Civil Code, that is, renewal (novation)? Whether and which amendments, if any, may be made by the court on the basis of Article 13(1) of the EPC? How much influence does the will of the aggrieved party or the will of the offender have on the manner in which such an obligation is to be performed and any modification thereof? The issues outlined are, among others, the subject of a broader analysis within this publication.

The article analyzes the possibility of invoking by a lawyer or legal adviser the legal protection guaranteed during and in connection with the performance of professional activities. This protection guarantees the unrestricted practice of the profession of advocate or legal adviser and ensures that citizens can effectively exercise their right to defence. The author argues that the concept of legal protection cannot be equated
with the immunity guaranteed to judges and prosecutors, which results in the exclusion of liability. This position has been confirmed in the jurisprudence of common courts. In many cases concerning traffic offenses committed by advocates or legal advisers, the courts have to deal with instrumental treatment and over-interpretation of the legal protection guaranteed in the constitutional acts of the bar and legal advisers. The jurisprudence of the courts is a reaction to attempts to abuse the discussed institutions and
a manifestation of the need to systematize the meaning of the terms “immunity” and “legal protection”

Incest is an extremely controversial crime today. The main reason for this is not only the lack of consistency as to the subject of protection, but also the threat of violation of the good in the form of sexual freedom by further penalizing incest. The arguments presented by the representatives of the doctrine are not homogeneous – some of them are willing to support the decriminalization of this crime. The article presents the ratio legis of the functioning of the crime of incest in the Polish legal order – taking into account its historical background and comparative legal remarks. The special relationship between morality and sexual freedom was considered in order to demonstrate the legitimacy of criminalizing incest.

The aim of the study is to examine the question of the substantive scope of the in dubio pro reo rule, i.e. the determination of a decades-long dispute whether the order to decide irresolvable doubts in favour of the accused, as expressed in Article 5 (2) of Polish Code of Criminal Procedure, also concerns legal matters, or whether it should only be used to clarify factual doubts. This article is a first comprehensive analysis of this issue. It sets out all the arguments put forward so far for each of the opposing views, as well as a number of own arguments which have not yet been taken into account. The first part of the text examines, inter alia, the legal nature of the in dubio pro reo directive, in particular its relationship with the presumption of innocence. The following section examines, inter alia, the impact of successive changes in criminal procedural law on solving the problem of the scope of the rule in question and compares the directive with similar rules in other fields of law.

The aim of the article is showing the legitimacy of the Supreme Bar Council’s legislative initiative to amend Article 245 of the Code of Criminal Procedure, aimed at improving the legal situation of detainees and to assess of the solutions suggested by the NRA, as well. The article analyzes the current state of the law from a legal standpoint of the compatibility of the current regulations with the standards arising from European law – which made it possible to identify areas of incompatibility and to examine whether thanks to the solutions suggested by the NRA, these legal discrepancies can be removed or at least – reduced.

The purpose of the present thesis is to analyze the issue of an adequate understanding of the concepts of “violation” and “rape”. The authors first focused on the etiology of these studied concepts and their location in the monuments of law that were in force in the past. A constitutive element of the historical part of the work is an interpretation of indicated terms and determination of the relationship between them. The Polish penal codes from 1932, 1969, and the current one from 1997 were subsequently analyzed, in which Polish legal thought was continued in the use of both the term “violation” and “rape” in criminal legislation’’.
